GENERAL TERMS AND CONDITIONS
The following terms and conditions apply to all purchases made on this website. Please read the information carefully. You agree that by making an order on this website, you have accepted such terms and conditions.
These Terms and Conditions are those in effect from 22 November 2014.
1 PURCHASE CONTRACT
"Agrumia" or "We" or "Us" or "Our" means Agrumia Limited, incorporated and registered in England with VAT number GB119587187, whose registered office is at Ash House Breckenwood Road, Fulborn Cambridge, CB21 5DQ. These Terms and Conditions govern all purchases made on this web site at any time. The Terms and Conditions those in effect at the date of your order will be applicable to all purchases, so if our terms and conditions have changed prior to your order, then when you order you will be obliged to comply with the changes contained. As a consequence, preceding each order you should check that you fully understand the Terms and Conditions applicable to the order. To facilitate this process, we have displayed the date in which these Terms and Conditions were last updated, so that you may easily view if they have been altered since your previous order.
We will certify that your order has been received. Validation can either be via a message on the website itself, immediately after you have placed your order or via email confirmation utilising the email address provided to us on your behalf. The purchase contract is thus to be considered completed and Agrumia will supply the goods in accordance with the order and to these Terms and Conditions.
You must be at least 18 years of age to use our website; and by using our website or agreeing to these terms and conditions, you warrant and represent to us that you are at least 18 years of age. You are also required to fill out our registration form to be able to utilise our services.
Agrumia does not sell any alcoholic beverages to individuals who are not 18 years old, and by placing an order, you warrant and represent to us that you are at least 18 years of age.
2 PRICE AND DELIVERY COSTS
The price of the goods will be as quoted on the web site at the time you confirm your order (usually by clicking the "checkout" button). The website contains a number of products and it is always possible that some of the prices on the website may be incorrect. We will verify prices as part of our sale procedures so that a product's correct price will be stated when you pay for the product. We are not liable for any inadvertent technical error which may occur. Any subsequent change to your order will follow the pricing applicable to the amended item(s) at the time in which the amended order is carried out. It is important to note that promotions and special offers are for a limited time period and amendments to your order may mean that the promotional items are no longer being offered at a special price.
Our prices are inclusive of VAT and all other tax, and all prices quoted are the final price to the consumer.
Prices are, however, not inclusive of delivery charge. There is no minimum requirement per order. For orders that are below £60, there will be a delivery charge applicable as follows: Please refer to the website for specific details.
3 PAYMENT METHODS
PayPal, Amazon Payments, Apple Pay, as well as all major Credit card payments are accepted.
Please refer to the website for a list of debit, credit and charge cards that are accepted as forms of payment on the date on which your order is placed.
Please note that American Express is not an accepted form of payment.
In the event that you fail to fulfil your payment obligations, you agree to indemnify us for all expenses and costs incurred for the obtainment of payments. There will also be an administrative charge applied of no less than £20. If a payment has failed, we may avail ourselves of a debt collection agency to obtain payment from you.
Deliveries shall be made to the address designated upon registration on our website. You will be able to edit the delivery address at checkout, if you should require delivery at a different location (for example, at your work address). We maintain the right to exclude some areas from our delivery offering.
Agrumia will always strive to fulfil all orders in full, for the complete order that has been submitted. If you should find that the order is in any way lacking in quantities in respect to what was ordered, or if wrong good were delivered, then you are to notify us as soon as possible. You will not be charged for incorrect goods received or for goods which you have not received. If you are not pleased with the quantities that have been received as part of your order then we can arrange for the goods to be returned (however, in this case, the goods must still be in good condition and not have been used). We will be liable for only the price of the goods incorrectly delivered or lacking, plus the cost of delivery, and not liable in any other way.
Agrumia will do its utmost to make deliveries in a timely fashion, according to the delivery slots specified. Conversely, it will be your responsibility to make sure that there is someone appropriate at the delivery address to sign for the delivery of the goods. If there is no one at the address specified at the time of attempted delivery, then the goods will not be delivered but rather retained by us. The delivery person will leave notice of the attempted delivery and we will telephone to rearrange for the delivery to be rearranged. Adverse weather conditions and other external events out of our control could result in late or cancelled delivery. If this situation should arise then we will do our utmost to reschedule with you an acceptable delivery time and date. Agrumia will be liable only limited to the price of the goods being delivered and the cost of delivery.
5 FAULTY GOODS
Agrumia takes great pride and guarantees the quality of our goods. Upon receipt of your order, should you inspect the goods and not find them to our satisfaction, you should notify us promptly. We will speedily refund in full the cost of the goods that do not meet your reasonable satisfaction and we will arrange for those goods to be returned to us.
In accordance with clause 7.1 below, no further claims will be recognized for loss from or in connection with the supply of defective goods, whether direct, indirect, consequential or arising in any other way.
6 CHANGES TO ORDERS AND CANCELLATION RIGHTS
You may change your order at any time up until 4 pm of the day prior to the day of delivery of your order. Up until this time, you may change your order or even cancel it without any charge for doing this.
7 GUARANTEES AND RESPONSIBILITY
Nothing contained in these Terms and Conditions can restrict our liability for death or personal injury resulting from our negligence, nor will any of these terms restrict any of your statutory rights.
Besides paragraph 4.3 Agrumia will not be deemed to be in breach of contract or of these Terms and Conditions for any delay or failure to perform if either situation is due to circumstances beyond our reasonable control including, but not limited to, acts of God, weather conditions, acts of public enemies, war, strikes, civil commotions, or acts or omissions of public authorities.
Beyond what is set out in clause 7.1, Agrumia maximum liability arising from any one order for the supply of goods to you is limited to the retail price of the goods contained in that order on the day of the order.
Agrumia has the utmost respect for your privacy. All personal information that is supplied to us is kept with attention and we aim to guarantee confidentiality. The personal information supplied will not be sold, rented or transferred to third parties, for marketing purposes or otherwise, unless expressly agreed upon by you.
When you register on the website, you will receive a password. Do take care to keep this password secret, as it will be your responsibility to preserve its confidentiality. All orders placed with your email address and that password will be attributed to you and all orders placed with this combination will be your responsibility. If you become aware of a breach of security, either to your email address or to your password, then you are required to notify said unauthorised use to us as soon as possible.
9 CONSUMER GRIEVANCES
All consumer grievances should be directed to the Agrumia Customer Service, whose e-mail and telephone numbers you can find on our website on the Contact Us page.
10 PROMOTIONAL OFFERS AND COMPETITIONS
At our discretion, Agrumia may decide that the purchase of specific goods will be subject to special promotional offerings. If such a promotion where to be applicable to your order, then the special promotional offering will still be subject to these Terms and Conditions. If there were to be a conflict between the terms of the promotional offering and these Terms and Conditions, then the latter will prevail unless specifically omitted.
Agrumia can, at any time, modify the terms of the promotional offer, or decide to withdraw it altogether. No prior notice is required.
Agrumia maintains the right to diversify their offering and has complete discretion in promoting offers and specific goods to different customers, as well as the possibility of entering specific competitions.
Vouchers will be valid for a period 3 months from when they have been issued unless specified otherwise. They may not be used in combination with other promotions unless specified otherwise. Vouchers are personal and non-transferable, and they may not be offered or sold to third parties. The vouchers are not applied retroactively and thus cannot be applied to past orders made with Agrumia, nor can they be converted to cash, as the vouchers are only applicable to orders of goods made on the Agrumia website. There is a minimum spend requirement that is applicable for the validity of the voucher, it will be specified on the aforementioned voucher. If the minimum spend is not specified, then it is given that the minimum order amount is in the amount of £60. Your statutory rights are not affected by this.
The Contract shall be governed by the laws of England and any dispute arising under or in connection with the Conditions or the sale of the Goods shall be subject to the jurisdiction of the English courts.
